AOC Digital Platforms Terms of Use

 

Why should I read these Terms?

3. Your use of the AOC Digital Platforms is governed by these Terms of Use (Terms) together with the AOC’s Privacy Policy and any additional terms, conditions, notices or disclaimers displayed on the AOC Digital Platforms. For example, if you wisht to participate in an AOC competition, you’ll need to agree to the competition terms and conditions displayed on the AOC Digital Platform. If there is any inconsistency between any additional terms and conditions and these Terms, the additional terms and conditions will prevail.

4. You should review these Terms of Use and our Privacy Policy carefully and immediately cease using our Digital Platforms if you do not agree to these Terms.

5. From time to time, we may review and update these Terms of Use. Any updates to these Terms of Use will be posted on our website olympics.com.au.

6. By accessing or using the AOC Digital Platforms you agree to be bound by these Terms of Use as they apply from time to time.

What information do we collect about you and how do we use it?

7. When you access the AOC Digital Platforms and when you register your personal details with us on the AOC Digital Platforms, we will collect certain information about you.

8. Our Privacy Policy explains:
a. how we collect, store, use and disclose, and how you may access and correct, your personal information;
b. how you can lodge a complaint regarding the handling of your personal information; and 
c. how we will handle any complaint.

9.    If you provide us with personal information on behalf of another person, you warrant that you have the person’s consent to do so and that you have provided the person with details of these Terms and our Privacy Policy. You also warrant that in collecting and storing any personal information you collect to provide to us, you are complying with the Privacy Act 1988 (Cth).

What kind of information is available on the AOC Digital Platforms?

10. The information on the AOC Digital Platforms is intended only to provide a summary of the subject matter covered and is not intended to be comprehensive. While we use all reasonable attempts to ensure the accuracy and completeness of the information on the AOC Digital Platforms, to the extent permitted by law, including the Australian Consumer Law, we make no warranty regarding the accuracy or completeness of information on the AOC Digital Platforms.

How can I use the AOC Digital Platforms?

Intellectual Property
11. Unless otherwise indicated, we own or licence from third parties the copyright and other intellectual property rights in the content of the AOC Digital Platforms. Please respect these rights. 

12. Your use of the AOC Digital Platforms does not grant or transfer any rights, title or interest to you in relation to the AOC Digital Platforms, including any content. 

13. While you may browse or print the content for your personal, non-commercial use, you must obtain our prior written permission if you’d like to use, copy or reproduce any part of any AOC Digital Platform (including content) for any other purpose. You may not otherwise modify, copy, distribute, transmit, display, perform, reproduce, publish, license, commercially exploit, create derivative works from, transfer, or sell any content, software, products or services contained within the AOC Digital Platforms.

Unacceptable activity
14. It’s your responsibility to ensure that your use of the AOC Digital Platforms, including any posts or contributions, do not breach any appliable laws or rights.

15. When using the AOC Digital Platforms you must not:
a. breach the privacy or intellectual property rights of others (e.g by uploading personal information without an individual’s consent); and
b. upload any material that contains viruses or code designed to interrupt, limit or impair the performance, security or functionality of the AOC Digital Platforms or the property of other individuals.

Contributions
16. If we allow you to post contributions (Contributions) on the AOC Digital Platforms you must not post Contributions which:
a. are inflammatory (e.g. trolling);
b. are racist, abusive, harassing or hateful;
c. are false, defamatory, inaccurate, threatening, invasive of a person’s privacy or constitute personal abuse directed at others;
d. are obscene, sexually explicit or pornographic or contain links to other sites that contain or promote obscene, sexually explicit or pornographic material;
e. constitute commercial advertising, marketing or spamming, promote or solicit any goods, services or commercial activities, or transmit any sort of “junk” mail;
f.  involve the impersonation or any person or entity; or
g. violate any applicable law.

17. Further, we have the right to:
a. monitor use of the AOC Digital Platforms;
b. edit, modify, reject and / or remove any Contribution at our sole discretion and without notice; and
c. share your information with appropriate government or mental health support organisations if we consider that you may be at risk of causing serious harm to yourself or others and/or would benefit from mental health information or support.

18. By making your Contributions available to the AOC:
a. you represent that your Contributions are your own work and do not include any information which infringes the rights of others; and
b. you grant the AOC an irrevocable, non-exclusive, worldwide, royalty free, perpetual licence to use, publish, reproduce, edit and exploit your Contribution in any form and for any purpose and you unconditionally waive all moral rights which you may have in your Contributions and to the extent the law does not permit waiver of moral rights, you consent to any and all acts or omissions of the AOC that would otherwise constitute an infringement of your moral rights.

Do the AOC Digital Platforms contain linked sites?

19. Our Digital Platforms may contain links to other sites or platforms operated by third parties over which we have no control. Those links are provided for convenience and we are not responsible for their use, effect or content. By accessing such third party sites you agree to any terms of use imposed by those sites. We do not endorse any material on third party sites and do not provide any warranty or assume any responsibility regarding the quality, accuracy, source, merchantability, fitness for purpose or any other aspect of the material on those sites, nor do we warrant that material on other sites does not infringe the intellectual property rights of any other person.

Warranties and disclaimers

20. To the maximum extent permitted by law, including the Australian Consumer Law, we make no warranties or representations about the AOC Digital Platforms, including but not limited to warranties or representations:
a. the AOC Digital Platforms will be complete, accurate or up-to-date;
b. that any errors, omissions or defects will be corrected; or
c. that access to the AOC Digital Platforms will be uninterrupted, error-free, free from viruses or secure.

21. We reserve the right to restrict, suspend or terminate without notice your access to any AOC Digital Platform, any Contribution, or any feature of any AOC Digital Platform at any time without notice and we will not be responsible for any loss, cost, damage or liability that may arise as a result of such actions.

22. We are not responsible for any material or Contribution uploaded, posted, transmitted or otherwise made available on the AOC Digital Platforms by any person other than the AOC. Also, we do not endorse any opinion made by any person other than the AOC.

Liability

23.    Please take your own precautions to ensure that your use of any AOC Digital Platform does not interfere with or damage the operation of your computer system.

24.    To the maximum extent permitted by law (including the Australian Consumer Law), we exclude all liability arising from or in connection with:
a.    your or another’s use of any AOC Digital Platform, including interference with or damage to your computer system;
b.    the information, materials or Contributions on any AOC Digital Platform, including if the information, materials or Contributions which are incorrect, incomplete, not up-to-date or in breach of these Terms; or
c.    the inaccessibility of any AOC Digital Platform.

25.    To the extent our liability cannot be excluded by law, our liability is limited to resupplying the relevant goods / services to you, subject to any rights under the Australian Consumer Law.

26.    In no circumstances will the AOC be liable for any indirect, special or consequential losses or damages of any nature however arising in connection with your use of any AOC Digital Platform.

How can I report a concern with the AOC Digital Platforms

27. If you have any concerns with the content on the AOC Digital Platforms, including if you believe the content is unlawful or in breach of these Terms, please contact the AOC via aoc@olympics.com.au.

Jurisdiction and governing law

28. Your use of the AOC Digital Platforms is governed by the law of New South Wales and you submit to the non-exclusive jurisdiction of the courts exercising jurisdiction in New South Wales.
